The USA is not likely going to back down from its position regarding online gambling. This is depsite facing billions of dollars in claims. It is the opinion of the US that their current course of action is the best way of achieving closure on this issue. An unnamed source has been quoted as saying “we are trying to clarify that our obligations should not extend to gambling. ”
This is based on Article 21 in the General Agreement on Trade in Services. An offshoot of this Article is that the USA must reach settlements with all WTO members which filed compensation claims in this regard. Antigua and Barbuda called on the members of the WTO to join in filing compensation claims against the US. Many of the countries answered the call based on the fact that it was declared that the US was in continued violation of its commitments under the GATS.
There are constant negotiations continuing under Article 21 with all of the members of the WTO that have made claims. They were hoping that an expeditious solution could be reached by using this procedure to resolve the problem. It is however notable that all of the members who made claims were being reasonable about the situation and understood the seriousness of the matter, urging them to try and resolve the matter.
